Developer’s contract – notary’s act

The signing of the preliminary sales contract in the form of the notary’s act must be accompanied by a deposit of at least 20% of the value of the place purchased (optionally with the parking spot). Apart from the legally binding promise of the sale of the chosen estate, the contract contains the pre-arranged schedule of payment; should the estate be purchased in installments, we offer either the standard quarterly schedule or an individualized one. What is important is the fact that the schedule is an integral part of the contract, thus ensuring the customers know the exact price of their future home the moment the agreement is met. And once the construction is completed, the ownership act can be signed.

Contract for establishing separate ownership of a place and for sales
The primary stipulation for the contract is the payment of all the remaining payments as scheduled in the preliminary contract. The immediate effect of signing the contract is the transmission of ownership rights to the place (and optionally a parking spot) together with a share of land, for which an individual entry in the Land Register will be made. On the day of the signing of the contract, the customers receive the keys to the chosen estate.
Thus, all the buyers become owners of apartments and automatically members of a housing cooperative created by all the residents of a given building, based on the Bill of apartment ownership (Ustawa o własności lokali).
Legally, a three-year warranty for the obtained property – i.e. the flat and all linked immobility – dated on the day of the formal acquisition of ownership over it. The warranty stems from the regulations of the Civil code and is mandatory; in addition, we extend a 36 month guarantee.
